Information obligation pursuant to Article 13 of the General Data Protection Regulation (GDPR)

Your data in the MOBI Foundation

Dear Client,

The law has changed — since 25 May 2018, the General Data Protection Regulation (GDPR) has been in force, unifying the rules for the processing of personal data throughout the European Union. Therefore, we would like to inform you that:

The controller of your personal data provided in connection with the use of our services is the MOBI Foundation, which operates the continuing education institution Polish Linguistic Institute, registered by the District Court for the Capital City of Warsaw, 12th Commercial Division of the National Court Register, under number KRS 0000612039, address: ul. Mazowiecka 12/24, 00-048 Warsaw, Poland, e-mail: kontakt@instytutjezykowy.pl, hereinafter referred to as MOBI.

Your data:

a) are stored in accordance with applicable data protection regulations, in particular the Personal Data Protection Act of 10 May 2018;
b) if you decide to enter into an agreement with us, your data will be processed for this purpose, including the provision of services and processing of payments (legal basis — performance of a contract);
c) after the agreement has been completed, we may continue to process your data for the purpose of handling possible complaints or claims (legal basis — our legitimate interest);
d) your data may also be processed for issuing and storing invoices and other accounting documents (legal basis — fulfilment of legal obligations).

If we process your data based on consent, it will be processed until such consent is withdrawn. In all other cases, your data will be stored only as long as necessary to achieve the purposes for which it was collected.

We process your personal data because it is necessary to provide our services, including:

a) enabling the provision of electronic services and full use of the website www.instytutjezykowy.pl
(hereinafter referred to as the “Website”);
b) creating and managing your account, ensuring account support, transaction handling and resolution of technical issues;
c) processing complaints if you file one;
d) handling inquiries you send to us;
e) contacting you for purposes related to the provision of our services;
f) complying with tax and accounting obligations required by law.

We also process your personal data on the basis of our legitimate interest, including for:

a) monitoring your activity, including searches and interactions on the Website or online store;
b) tailoring advertisements to previously viewed content and adjusting categories or specific offers displayed on the Website;
c) conducting marketing activities, including direct marketing of our own services or goods, as well as those of third parties;
d) contacting you for legitimate marketing purposes through available communication channels, in particular via e-mail or telephone;
e) ensuring the operation of payment services;
f) ensuring the security of electronic services, enforcing internal rules and preventing fraud or abuse;
g) handling your requests submitted to our customer service department or via the contact form when they are not directly related to contract performance;
h) organising loyalty programmes, competitions and promotional campaigns in which you may participate;
i) debt recovery and conducting court, arbitration or mediation proceedings;
j) archiving data and ensuring accountability (demonstrating compliance with legal obligations).

We process your personal data ourselves and also share it with entities cooperating with us to ensure the highest quality of services. These include IT and hosting service providers, as well as legal and accounting service providers. These entities process your personal data on our behalf and solely for the purposes specified above.

Providing your data is voluntary, but necessary to achieve the objectives listed above.

We inform you that none of your personal data is processed in any automated decision-making processes (including profiling).

A person whose data is processed has the right to access their data, request rectification, erasure, or restriction of processing, the right to data portability, the right to object, and the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
Upon your request, we will provide you with a copy of your data; for each subsequent copy, we may charge a reasonable administrative fee.

The competent supervisory authority for such matters is the Personal Data Protection Office (Urząd Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warsaw, Poland.

You also have the right to withdraw your consent to data processing at any time. However, this will not affect the legality of data processing carried out prior to the withdrawal.

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
