RULES FOR PARTICIPATION IN LANGUAGE COURSES ORGANISED BY THE NON-PUBLIC LONG LIVE EDUCATION INSTITUTION POLISH LINGUISTIC INSTITUTE IN WARSAW

Buyer — a person who has made a purchase online.

Course — one of the courses offered by the school; descriptions of individual courses are available on the institution's website. The course may be conducted in person at ul. Mazowiecka 12/24, 00-048 Warsaw, or online.

1. Scope of application of the General Terms and Conditions

1.1 The General Terms and Conditions apply to all courses at the Polish Language Institute in Warsaw.

1.2 The General Terms and Conditions are available at the office of the Polish Language Institute in Warsaw and on the website www.instytutjezykowy.pl.

Students are informed of this when registering for a course. By paying for the course, the student concludes a contract with the Polish Language Institute for the course and at the same time confirms that they have read the General Terms and Conditions of Participation.

2. Basic conditions

2.1 Persons wishing to participate in language courses at the Polish Language Institute in Warsaw must be at least 16 years of age.

This does not apply to courses for children and young people — in such cases, the consent of a legal representative is required.

2.2 The Polish Language Institute adheres to the principle of equal treatment, i.e. every individual, regardless of gender, race, ethnic origin, nationality, religion, worldview, disability, age or sexual orientation, is treated equally with other individuals in a similar situation.

3. Prices

3.1 Information on current prices at the time of registration is available in the current price list, available at the office of the Polish Linguistic Institute in Warsaw and on the website www.instytutjezykowy.pl.

3.2 No administrative fee is charged in the event of a change of group.

3.3 Payment for the course entitles you to free use of the library of the Polish Linguistic Institute in Warsaw.

3.4 Payment for the course includes the cost of teaching materials.

4. Terms of payment

4.1 Payment for the course can be made:

a) by bank card at the secretariat of the Polish Linguistic Institute in Warsaw,

b) in cash at the secretariat of the Polish Linguistic Institute in Warsaw,

c) by bank transfer to the account:

4.2 Students who continue their studies can pay for the course by bank transfer to the account specified in the contract. The transfer must be credited to the MOBI Foundation's account no later than 2 weeks before the start of enrolment. Only timely payment guarantees a place on the course.

4.3 The moment of payment for the course is considered to be the moment the amount is credited to the MOBI Foundation's bank account.

5. Withdrawal from the contract — a contract concluded at a distance

5.1 If the Agreement is concluded remotely or outside the premises of the Polish Linguistic Institute, the Participant has the right to withdraw from it within 14 days without giving any reason and without incurring any costs, except for the costs referred to in points 5.4 and 5.6 below.

5.2 The period for withdrawal from the Contract begins on the date of its conclusion. To meet the deadline, it is sufficient to send a statement of withdrawal before its expiry.

The Participant may withdraw from the Agreement by submitting an unambiguous written statement of withdrawal to the Polish Linguistic Institute, for example by letter to the following address:

5.3 The statement may be submitted using the form provided in Appendix No. 2 to the Act of 30 May 2014 on consumer rights, or using the form available at the Organiser's office (ul. Mazowiecka 12/24, 00-048 Warsaw), however, this is not mandatory.

5.4 If, upon conclusion of the Agreement, the Participant received a textbook, they are obliged to return it to the Polish Linguistic Institute in undamaged condition to the following address: ul. Mazowiecka 12/24, 00-048 Warsaw, or hand it over to an authorised representative of the Institute no later than 14 days from the date of withdrawal from the Agreement.

The Participant shall bear the direct costs of returning the book.

If the textbook has been unpacked or the protective film has been removed, the Participant is obliged to pay its cost in the amount of PLN 75 — in this case, the textbook is not returnable.

5.5 The Participant has the right to submit a clear request to commence the provision of Services before the expiry of the deadline for withdrawal from the Agreement.

5.6 If the Participant has exercised their right of withdrawal after the commencement of the provision of Services at their own request, they are obliged to pay the cost of the Services provided until the moment of withdrawal.

6. Withdrawal from the course

6.1 Withdrawal (termination of the contract) must be submitted in writing, otherwise it shall be invalid.

6.2 If the Agreement is concluded for more than one course (module), the Participant has the right to withdraw from subsequent modules before they begin. In this case, they are not obliged to pay for these modules, and if they have already made the payment, the amount will be refunded.

The following rules apply to the first module.

6.3 For contracts concluded for one module, as well as for the first module of a course consisting of several modules, the Parties agree that:

•    in the absence of visa or permit documents issued in connection with participation in the course, the Organiser may provide an online course (if there are groups available),

•           in case of withdrawal from the course no later than 30 days before the start of the first module, the course fee shall be refunded minus an administrative fee of PLN 500,

•           if the course is cancelled no later than 14 days before the start of the first module (but before its start), the course fee will be refunded minus PLN 600,

•    if the Participant cancels after the start of the first module, the course fee will be refunded minus 80% of the cost of the first module.

6.4 If there are fewer than 5 participants in a standard group, the Polish Linguistic Institute in Warsaw reserves the right to:

•    disband the group or

•    offer training in a small group:

4 participants — 40 hours

3 participants — 32 hours

2 participants — 20 hours

6.5 If the course is disbanded by the Polish Language Institute, the participant will be refunded the full amount for the course. It is also possible to transfer to another group if there are places available.

6.6 Notwithstanding the above, the course fee will be refunded in full only in the event of serious illness or accident, confirmed by relevant documents. The final decision is made by the Organiser.

6.7 The refund will be made to the Participant's bank account within 14 days of the date of acceptance of the withdrawal request or notification of termination of the Agreement.

7. Group allocation / group size

7.1 Group allocation is based on the results of a test and interview at the Polish Language Institute in Warsaw, or on the basis of a valid certificate of completion of a previous course at the Institute.

7.2 Standard course groups at the Polish Language Institute in Warsaw consist of a maximum of 10 people and a minimum of 5 people.

7.3 A student may join a group after the start of the course (if there are places available), but no later than the fourth class, paying the full cost of the course.

8. Participation in classes

8.1 Students of the Polish Language Institute in Warsaw are required to adhere to the rules of conduct and social norms.

8.2 Participation in classes of a group other than the one to which the student has been assigned is not permitted.

9. Technical conditions for participation in online courses

9.1 Use of the course is possible provided that the user has a graphical web browser and Internet access.

9.2 The system has been created using technologies that allow it to be used on most modern personal computers, operating systems and types of Internet connections.

9.3 The user gains access to the system after logging in through the application. To log in, you must enter your username and password. The user is responsible for keeping their access data safe and is obliged to change it periodically for security reasons.

9.4 When providing services, in some cases, cookies may be stored in the Operator's telecommunications system.

9.5 The system's web pages are optimised for browsers with a resolution of 1024×768 pixels.

9.6 Due to technological changes, the specified technical requirements are subject to change. Previous software may be replaced by newer versions.

9.7 Course participants are obliged to use the system in accordance with applicable law, public morality and good manners.

9.8 Platform users are prohibited from transmitting any illegal or offensive material, in particular those that:

• violate the personal rights of third parties,

• incite hatred on racial, ethnic or religious grounds,

• contradict generally accepted social norms.

10. Attendance (hospitalisation)

As part of the course, classes are observed (hospitalisation) by the Director of the Polish Linguistic Institute in Warsaw, a non-public continuing education institution, in order to maintain high teaching quality.

11. Certificate of completion

11.1 Upon completion of the course, each student may receive a certificate of successful completion of the course if:

a) they have attended at least 80% of the classes,

b) they have fulfilled all the requirements of the teachers (homework, presentations, etc.), or

c) they have passed the assessment tests (interim and final).

Passing the final test confirms that the material from the mid-term test has been mastered.

Therefore, if a student fails the mid-term test but passes the final test, they are considered to have successfully passed both.

11.2 The certificate of completion entitles the student to participate in the next level of the course.

11.3 If a student receives less than 50% of the points or is absent during the test, they have the right to retake the test before the start of the new semester.

The test date is agreed with the teacher and the secretariat.

12. Limits of liability

The liability of the Polish Language Institute in Warsaw and its team is limited to cases of intentional acts.

The Institute is not liable for failure to fulfil its obligations caused by force majeure circumstances, such as natural disasters, fires, floods, war, orders of public authorities or other situations beyond the control of the parties.

13. Complaints and claims

13.1 Complaints and comments should be submitted in writing to the secretariat of the Polish Language Institute in Warsaw.

The director of the institution will respond to complaints in writing within two weeks.

The user has the right to submit a claim regarding participation in courses.

13.2 If the information provided in the complaint requires clarification, the Polish Language Institute or an authorised person will contact the applicant to obtain additional information.

Complaints shall be considered within 14 days of the date of submission.

14. Validity of the General Terms and Conditions of Participation

14.1 The Polish Language Institute in Warsaw has the right to amend these General Terms and Conditions of Participation.

The changes shall take effect on the date specified by the Institute, but not earlier than 14 days after the students have been notified of the new version of the Rules.

14.2 These provisions of the General Terms and Conditions of Participation shall enter into force on 01.12.2024.
